Terms of Service for Key Forecasts

Welcome to Key Forecasts, operated by DTLA Professional Services, LLC. By using our website, services, financial dashboard, or interacting with our partner program, you agree to comply with these Terms of Service (“Terms”). If you do not agree, please discontinue use of our services immediately.

1. Services Provided Key Forecasts provides strategic financial control, fractional CFO services, accounting, and financial reporting tailored to skilled trades and HVAC businesses. All services are subject to the scope agreed upon in signed contracts or service agreements.

2. Eligibility Services are provided only to business owners or authorized representatives of businesses. You must be at least 18 years old to use our services. We proudly serve businesses located throughout the United States.

3. Client Responsibilities To receive our services, you agree to:

  • Provide accurate, complete, and timely information necessary for service delivery.
  • Ensure compliance with any legal or tax obligations related to your business.
  • Notify us promptly of any changes to your business information.

4. Financial Dashboard Access and Use

  • Access: Access to the Key Forecasts Fractional CFO dashboard requires successful upfront payment of the initial subscription fee.
  • Usage: The dashboard helps you track profitability, manage pricing, and analyze financials. You agree not to misuse, reverse-engineer, or attempt to gain unauthorized access to the platform’s underlying infrastructure.
  • Data Accuracy: While we strive for absolute accuracy, the dashboard’s insights depend heavily on the financial data you input or connect. Key Forecasts is not liable for business decisions made based on user input errors or delayed data synchronization.

5. Partner (Affiliate) Program The Key Forecasts Partner Program allows eligible individuals to earn a $100 one-time commission for referring new clients.

  • Tracking: Referrals are tracked using a persistent 30-day cookie. To qualify for a commission, the referred user must register and complete payment within this 30-day window.
  • Payout Timeline: All commissions undergo a 20-day holding period to protect against fraud, refunds, and chargebacks. On Day 21, valid commissions are cleared and marked ready for payout.
  • Disqualification: If a referred client fails to complete checkout, requests a refund, or initiates a chargeback during the holding period, the pending commission is voided.
  • Payments: Cleared commissions are paid out via manual transfer (e.g., Zelle, Venmo, or PayPal) according to the preferences saved in your Partner Portal.
  • Termination: We reserve the right to suspend or terminate affiliate accounts engaged in spam, fraudulent self-referrals, or brand misrepresentation.

6. Payment Terms

  • All invoices and subscription fees must be paid in accordance with the terms specified at checkout or in your service agreement.
  • Payments are processed securely through Stripe or other approved payment processors.
  • Late payments or failed billing may result in immediate suspension of dashboard access until the balance is resolved.

7. Confidentiality We take the confidentiality of your information seriously:

  • All financial and business data provided will remain confidential.
  • We will not disclose your information to third parties except as necessary to provide services (e.g., payment processing or software integration) or as required by law.

8. Intellectual Property All content on our website and within our dashboard, including text, images, logos, proprietary financial models, and tools, is the intellectual property of Key Forecasts. You may not copy, modify, distribute, or reuse any content without written permission.

9. Third-Party Tools We use third-party tools and services, including but not limited to Google, Stripe, HubSpot, Namecheap, Calendly, ContentSnare, and others. Your use of these services is subject to their respective terms and conditions.

10. Limitations of Liability Key Forecasts is not responsible for:

  • Errors or omissions in information provided by clients.
  • Any losses or damages arising from the use of third-party services or tools.
  • Indirect, incidental, or consequential damages related to our services.

Our liability for direct damages is limited to the amount paid for services rendered.

11. Termination of Services

  • Either party may terminate the service agreement with written notice, subject to the terms of the contract.
  • Upon termination, all outstanding fees must be paid immediately, and dashboard access will be revoked.

12. Compliance with Laws We comply with all applicable state and federal laws, including but not limited to tax laws, financial reporting standards, and privacy regulations.

13. Dispute Resolution

  • Any disputes will be resolved in accordance with California state laws.
  • Disputes may be resolved through mediation or arbitration before pursuing legal action.
