By visiting https://keyforecasts.com or related hosts (including keyforecasts-la.web.app), using the contact form, or using the on-page cash snapshot, you agree to these Terms and to the Privacy policy and Cookie policy. If you do not agree, do not use the site.
Who we are — and who we are not
Key Forecasts is a division of DTLA Professional Services, LLC. We describe fractional controller services: monthly financial reporting, financial analysis, and cash-flow forecasting for small businesses in Los Angeles, CA.
- We are not a CPA firm and we do not issue audit opinions or compiled financial statements under AICPA standards unless a separate engagement says otherwise.
- We do not prepare or file tax returns from this website.
- We are not a law firm, broker-dealer, or investment adviser.
- We do not process payments on this website.
- Sister software listed on Our Apps is offered on those products’ own terms. Using PayXT, Trackkr, or another app is not the same as hiring the controller practice.
No professional relationship by browsing
Reading pages, using the calculator, or sending a strategy-session request does not create a client relationship, a fiduciary duty, or an obligation to take you on. We may decline work that is a poor fit (including tax-only work or books that need a different specialist).
A paid engagement starts only when both sides sign a written agreement that states scope, fees, and responsibilities. If those documents conflict with these website Terms, the signed agreement controls for the engagement.
Informational content and calculators
Guides, FAQs, service pages, examples, dollar figures, the 13-week cash snapshot, the cash runway simulator, and the job-costing analyzer are educational illustrations. They are not a forecast of your business, a guarantee of margin, or a substitute for a model built from your books. Labor burden, tax, insurance, and seasonality in Los Angeles vary by firm.
Testimonials or composite examples, if shown, illustrate a type of outcome. They are not a promise that you will get the same result.
Articles may mention California rules (for example labor costs or Section 179) at a high level. Tax law changes. Confirm with your CPA.
Eligibility
You must be at least 18 and able to form a contract under California law. The site is for business use, not for children. You may not use the site if you are barred from receiving U.S. services under applicable sanctions.
License to use the site
We grant a limited, revocable, non-exclusive, non-transferable license to access public pages for your internal business evaluation of our services. You may not copy the site to run a competing practice, scrape it in a way that overloads the servers, reverse engineer the form’s security, or present our content as yours.
Search engines and the AI crawlers listed in robots.txt may index public pages. That permission does not allow someone to lift our guides wholesale into a paid product without permission.
Intellectual property
Site copy, layout, logos, photographs (including the biography gallery and certificates displayed with permission of Rafael Gutierrez Jr.), and code are owned by us or our licensors. Trademarks of other companies (QuickBooks, Google, Stripe, and similar) belong to them. Do not use “Key Forecasts” or our marks in a way that suggests sponsorship without written consent.
Contact form and communications
If you submit the form, you ask us to respond using the email and phone you provide. You consent to return email and phone calls about that inquiry. We do not enroll you in a marketing text program from this site. Message and data rates from your carrier may apply to calls you place.
You agree the information you send is accurate to the best of your knowledge and that you have the right to send it. Do not submit other people’s personal data unless you are authorized. Do not submit malware, threats, or content that is illegal.
We use technical measures against bots (reCAPTCHA Enterprise, honeypot, timing, rate limits). Circumventing those measures is prohibited.
You grant us a limited license to process the submission as described in the Privacy policy so we can reply and keep records of the inquiry.
Acceptable use
You may not:
- Interfere with the site, probe it without authorization, or overload the contact function
- Impersonate another person or misrepresent your firm
- Use the site to send spam or harvest emails (we do not publish a staff inbox here)
- Frame the site or scrape it for a competing commercial dataset in violation of the license above
- Use the content as certified professional advice for a third party
Third-party sites and apps
Links to social networks, Google policies, sister apps, and other sites are provided for convenience. We do not control those sites and are not responsible for their content, cookies, or downtime. Your use of Google reCAPTCHA is also subject to Google’s terms.
Monitoring
We use Google Tag Manager (GTM-NB5KMLPJ) to monitor how the public site is used. That is described in the Cookie policy. We may review form submissions and server logs to operate and secure the service.
Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that content is complete or current.
Professional finance work depends on complete books and your decisions. Website copy cannot replace that work.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, DTLA Professional Services, LLC AND ITS PRINCIPALS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM THE SITE OR FROM RELIANCE ON WEBSITE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY ARISING FROM THE WEBSITE (NOT FROM A SIGNED CLIENT AGREEMENT) WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some rules do not allow certain limits; in those cases the limit is the maximum allowed. Nothing in these Terms limits liability for fraud, willful injury to person or property, or other liability that California does not allow to be waived.
Liability for contracted controller work is only as stated in that agreement.
Indemnity
You will defend and indemnify DTLA Professional Services, LLC and its principals against claims, damages, and reasonable legal fees arising from your misuse of the site, your form submissions, or your violation of these Terms, except to the extent caused by our willful misconduct.
Copyright complaints
If you believe content on this site infringes your copyright, send a notice that meets 17 U.S.C. § 512 to us via the contact form (put “DMCA” in the message) or by mail to the address above. Include your signature, the work claimed, the URL, your contact information, and the required statements of good faith and accuracy.
Privacy and cookies
Our collection and use of information is described in the Privacy policy. Cookies and Google Tag Manager are described in the Cookie policy.
Languages
We offer conversations in English and Spanish. If a translation of these Terms appears, the English version controls.
Changes and termination
We may change these Terms by posting a new effective date on this page. Continued use after that date is acceptance of the new Terms for later visits. We may suspend or stop the site, or block abusive traffic, without notice.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Exclusive venue for disputes about the website is the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.
Miscellaneous
If a provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. These Terms, plus the Privacy and Cookie policies, are the entire agreement about the website. They do not create a partnership or employment relationship. You may not assign these Terms; we may assign them in connection with a transfer of the practice.
